Any worker can report wrongdoing internally or externally. Past employees can also report wrongdoing. Whistleblowers do not have to be United States citizens.

Retaliation happens when a whistleblower experiences, or is threatened with, disciplinary action, demotion, a significant change in work assignment, or firing as a result of reporting wrongdoing. Retaliation is illegal in most workplaces. Harassment — like lack of promotion, removal of privileges, or loss of responsibilities — can also be considered retaliation.

Severance packages

Severance packages generally entail an offer of payment, stock options, or insurance in tandem with a termination, layoff, or retirement. In return for payment or benefits, severance contracts often stipulate that the employee receiving the severance will not sue the employer or collect unemployment.

Companies are not legally obligated to provide severance packages, but many have formal severance policies. Before you sign a severance agreement, you need to understand the terms and feel completely comfortable with what is expected of you in return for severance payment.

Non-compete agreements

A non-compete agreement, or non-compete clause, usually obligates an employee not to work for or start a competing business. As an employee, before you sign a non-compete agreement, you need to be sure that geographic restrictions and time limitations are reasonable and they won’t negatively impact your ability to earn a living down the road. As an employer, you need to be sure that your clause is reasonable and enforceable in court.

Policies and procedures

Well-written policies and procedures can protect your organization from legal issues, including litigation. At a minimum, your business should have clearly documented policies regarding workplace safety, disciplinary procedures, device use, and work hours.
